They are among more than 2,300 children split up from their families as a outcome of the "zero tolerance" practice that saw their parents prosecuted for illegally crossing the border, even if they did so to seek asylum.

Foster care placement provider Bethany Christian Services, which operates in MI and Maryland, said the seven children under five in its care had been reunited or had travel arrangements for reunification. While parents were criminally prosecuted, children were placed in custody of the Health and Human Services Department. More than 50 children under age 5 could be back in the arms of their parents by the deadline at the end of the day, the Justice Department said.

The infant is one of hundreds of children who have yet to be reunited with their parents, with many separated from their families under the Trump administration's recently rescinded "zero tolerance" family separation policy.

Sabraw said Tuesday that "full background checks of other adults in the household are not necessary under these unique circumstances".
