Palestinians demand full ICC investigation into 'Israeli war crimes'

"If Israel faces a united front of Islamic nations, it will never be able to continue its crimes", Rohani said.

"It is vital for the ICC to assume a principled and just stand and open an official, speedy and criminal investigation into Israel's egregious violations being committed throughout occupied Palestine".

But Israel is not a member of the ICC, and the Israeli foreign ministry on Tuesday said it "takes a severe view" of the referral, which it called "a cynical step without legal validity".

In a summary of its referral, the Palestinian Foreign Ministry alleged that Israel maintains and protects its settlements "by committing war crimes, crimes against humanity and the crime of apartheid against the Palestinian people".

Should the court's chief prosecutor, now Fatou Bensouda of Gambia, agree to take up an investigation of Israel, the case faces a series of time-consuming hurdles.

Last week another global body, the United Nations Human Rights Council, considered a resolution to "urgently dispatch an independent, worldwide commission of inquiry" to investigate "all alleged violations and abuses" of civilians since the latest Gaza protests began on March 30.

Referring to the Israeli army's killing of 111 Palestinian protesters in the Gaza Strip since March 30, Shakir told Al Jazeera: "The calculated killings of over 100 Palestinians in demonstrations in Gaza highlights the importance of the International Criminal Court prosecutor opening a formal investigation into serious crimes in Palestine".

The Palestinians have repeatedly accused the USA of siding with Israel, especially after the Trump administration recognized Jerusalem as Israel's capital in December, followed by last week's embassy move.




The referral will include Israel's past, present and future war crimes and crimes against humanity against the Palestinian people. However, the court has not opened a full-blown investigation that could ultimately lead to indictments.

Israel, which came under intense global scrutiny over its handling of violence on the border on Monday and Tuesday, has accused Hamas of using the several weeks of mass protests as a cover for launching terror attacks against Israeli troops and civilians.

While the ICC can indict suspects, it has no police force and has to rely on cooperation from member states to enforce arrest warrants.

In 2004, the U.N.'s highest judicial organ, the International Court of Justice, ruled in an advisory opinion that the settlements breached international law.

Israel claims east Jerusalem as an inseparable part of its capital - though its annexation is not global recognized.

In late 2016, the UN Security Council also declared the settlements to be illegal. Israel captured both territories from Jordan in the 1967 Mideast war.

A four-ship Freedom Flotilla has set sail for the Gaza Strip to challenge Israel's decade-old blockade of the besieged territory.

About 600,000 Israelis live in over 230 settlements that are illegal under the global law, which prohibits construction on occupied land.
