Apple and Samsung are confronting each other in a California court for a third trial including a similar arrangement of five patents.

This position stems from a Supreme Court ruling in 2016 that was favorable to Samsung and is central to how damages are calculated in infringement cases involving design patents.

Two expert witnesses, called by Apple, testified to the sums being reasonable.

Tech giants Apple and Samsung are back in court today over their long-running patent feud. 'It's a particularly significant period for Samsung to have been infringing, ' Vellturo said, given this is the point the customer enters such an ecosystem.

After the latest retrial, Samsung, Apple and Intel are scheduled to stand together in the United States trade watchdog FTC's suit against Qualcomm for the latter's alleged attempt to charge its customers for patented technology that it did not actually use.

Samsung is asking the jury to determine how much each of these discrete elements is worth and then assess damages accordingly.

Samsung had objected to the size of the design patent portion of the existing penalty, which had been determined by how much profit it had made from selling the handsets.




The lawsuit will be about what damages Apple can extract from sales of Samsung smartphones.

It's been eight years since the original iPhone was first released, but Apple still regards the device as one of the biggest risks it has ever taken - enough that it could have cost the whole company. The case is Apple Inc v Samsung Electronics Co, 11-cv-01846, US District Court, Northern District of California (San Jose).

"They're seeking profits on the entire phone", he said.

The three specific design patents pertain to "rectangular shape, rounded corners and black glass of the iPhone's front face", according to Bloomberg. Risch said. "Apple's going to say it wasn't until you put it into our shape that you made any money on it, so you have to look at it holistically", he said. But Apple's patents "do not cover the entire phone", Quinn said, adding that they are entitled only to the profits of the infringing components, and "not on anything that's inside the phone".

Motorola appears to be working on a foldable smartphone that turns into a tablet, along with the likes of the Samsung Galaxy X, Apple foldable iPhone and Huawei foldable phone.

Samsung has argued that consumers have other reasons to buy a phone other than its original design.
