Clark said Ennis could be putting herself at risk by admitting she fabricated her initial story, but that he didn't think the district attorney's office would file charges against her.

Foster was charged with domestic violence with an allegation that he inflicted great bodily injury, forcefully attempting to prevent a victim from reporting a crime and possession of an assault weapon after the Los Gatos-Monte Sereno Police Department responded to a possible disturbance at a Los Gatos, California, home on February 11.

Even if Ennis does testify that Foster did not harm her as her recantation indicated, the district attorney's office could still pursue the case based on medical records, emergency phone calls and witness accounts.

Ennis, however, recanted some of the statements she made to authorities.

Ennis told police that Foster hit her 10 times and smashed her phone as she was calling 911.

That pushed Foster's plea hearing from April 30 to Tuesday.

Reuben Foster pleaded not guilty to three charges stemming from an alleged domestic violence incident in February.




"She was extremely upset and told him if he broke up with her she would 'trash his career, '" Rickard said.

Foster was stoic and hardly spoke during the first two hearings, but he occasionally smiled and joked with a friend who accompanied him to court on Tuesday. They will present evidence at the preliminary hearing and a judge will decide whether there is enough to go to trial, which could begin as early as July.

Investigators also revealed two weapons were discovered on the scene: a loaded.38-caliber pistol and a Sig Sauer short-barreled rifle. The Apr. 12 report indicated she was bruised and suffered a ruptured ear drum.

'Sadly too often, victims of domestic violence for a host of reasons choose not to cooperate with the process that holds their abusers accountable, ' said Jim Demertzis, supervising attorney in the DA's family violence unit. However, she has since changed her story, saying they instead came from a fight with a woman that occurred following a road-rage incident that happened within 48 hours of the incident with Foster.

A preliminary hearing was scheduled for May 17.On Feb. 11, Foster was arrested in Los Gatos after he allegedly dragged his girlfriend by the hair, physically threw her out of his house and punched her in the head at least eight times, reportedly puncturing her eardrum. He also voluntarily has agreed to stay away from the 49ers facility during offseason workouts.

But Clark said the way the case is shaping up, the team's cautious attitude could be rewarded well in advance of the start of the 2018 season. The team has said it will cut him if it's proven he hit Ennis, and he still could face at least a six-week National Football League suspension based on its domestic-violence policy. Lynch's words are unusually blunt for this sort of situation, and paint an ominous picture of Foster's 49ers future.
