According to the New York Daily News, a Manhattan Supreme Court Judge ruled Monday that Madonna's former friend Darlene Lutz was free to sell the possessions.

She sued the auction house and Darlene Lutz, who is the main source of 22 items, including jewellery, clothes and signed memorabilia.

In the letter, the 24-year-old rapper wrote to Madonna, then 37, that a continued interracial relationship would negatively impact his image. The "Ray of Light" singer filed a temporary restraining order against the Gotta Have It Collectibles auction house in an attempt to halt the sale citing that the was unaware of the items no longer being in her possession, let alone up for auction.

But a judge ruled that Madonna had forfeited her right to the items after signing a 2004 settlement agreement with Lutz following a nasty dispute. In it Madonna described two of her rivals, Whitney Houston and Sharon Stone, as "horribly mediocre", adding, "They're always being held up as paragons of virtue and some sort of measuring stick to humiliate me".

Past year the planned auction of a number of Madonna's intimate personal items was stalled after the American artist opened legal proceedings against the sale. The OG Material Girl lost a legal battle to prevent the auctioned sale of some of her intimate personal belongings, reports The New York Times.

Madonna has yet to comment on the court decision, but Lutz's attorney, Judd Grossman, is celebrating what he's called a "complete win" for his client.

"For you to be seen with a black man wouldn't in any way jeopardize your career, if anything it would make you seem that much more open and exciting", Shakur wrote.

"Yet before this action began, the plaintiff did not make any demand to return her possessions".

Madonna claimed that all the other items up for auction on gottahaverockandroll.com - which also included photos, a chequebook and a pair of worn undies - had also been stolen. "We were confident that Madonna had no claim whatsoever, and the judge clearly agreed with us".
