Couple get $37 million from Johnson & Johnson in talcum powder cancer suit

A jury in Middlesex County, New Jersey, awarded $30 million in compensatory damages on Thursday to a man who got cancer after decades of using talcum powder.

J&J faces talc-related lawsuits by 6,610 plaintiffs nationally.

Johnson & Johnson has been sued thousands of times over the past few years over its marketing of talcum powder.

Deposits of talc, one of the Earth's softest minerals, are often located near deposits of the minerals that constitute asbestos, and studies have shown the risk of cross-contamination during mining.

On top of the $37 million already awarded the jury could award punitive damages next week, which are generally assessed as punishment for unethical or negligent actions. Claims are largely based on allegations that the company failed to warn women about the risk of developing ovarian cancer by using its products for feminine hygiene.

Exposure to asbestos fibers has been linked to mesothelioma, an aggressive cancer that develops in the lining of the lungs, abdomen or heart.




"While we are disappointed with this decision, the jury has further deliberations to conduct in this trial and we will reserve additional comment until the case is fully completed", Johnson & Johnson spokeswoman Carol Goodrich said in a statement. A seven-woman jury in Middlesex County found both J&J and Imerys concealed the asbestos in their products, which files from Lanzo's legal team indicate they may have anxious about as early as 1969, per Bloomberg. "JOHNSON'S Baby Powder products contain only U.S. Pharmacopeia (USP) grade talc, which meets the highest quality, purity and compliance standards", a statement on the company's website reads.

Lanzo is also the first male plaintiff in a talc-related trial involving J&J.

However, no federal regulations exist. Brock, who followed that with a brief history of the company, which was founded in 1886, added, "It's just beyond believable that the good people at J&J would ever sell a product that contained asbestos".

Throughout a lengthy trial that began in late January, attorneys for the Lanzos accused J&J of withholding information from consumers about the health risks of asbestos in its talc-based products for almost half a century.

"Since the 1970s, talc used in consumer products has been required to be asbestos-free, so JOHNSON'S talc products do not contain asbestos, a substance classified as cancer-causing". "The evidence was clear that his asbestos exposure came from a different source such as the asbestos found in his childhood home or schools", a spokeswoman says, adding the firm will appeal. Ana Viscomi presided over the trial, which began on January 29. Johnson & Johnson said it was disappointed by the jury's most recent decision.
