When it became clear that McDougal was in talks with in negotiations with ABC and investigative journalist Brian Ross to tell her story, American Media offered her a contract for $150,000 to appear on the cover of "Men's Fitness" and "Muscle and Fitness Hers" and for her to write a monthly column, according to the lawsuit, which includes copies of the contract with American Media for the column.

The court dispute has drawn public attention to an issue that was previously sidelined.

Since Cohen was involved with the transaction, there's sure to be more drama to come on his end, but the crux of McDougal's lawsuit is that she was never made aware of the tabloid's common practice of "catch in kill" - by which they purchase stories and sit on them, just to guarantee that they won't ever be published elsewhere.

David Hoffman, a contract-law specialist at the University of Pennsylvania Law School who reviewed Daniels's nondisclosure agreement at The Fix's request, said that "when you read this contract, it's pretty clear that this isn't the first time they've [Trump's team] had an agreement, which is why there are so many weird clauses in there about paternity and about videotape".

Ex-Playboy model, Karen McDougal, is suing to break her silence about an alleged affair she had with Donald Trump.

McDougal is now the second woman pursuing legal action in order to be able to speak about an alleged affair with Trump. McDougal says her own lawyer pressured her to take the deal, and failed to disclose that the publisher didn't actually have to print the promised coverage. McDougal also claims that Davidson told her that her story was worth millions, and she signed the agreement.

But when she began talking to ABC News, AMI returned to her with the $150,000 payment for the objective of buying her story, "but it would not publish the story" because of Pecker's relationship with Trump, according to the lawsuit. "This was meant to jumpstart her career".

Through efforts including the collusion of her own lawyer, AMI has consistently deceived and manipulated Ms. McDougal through an illegitimate contract.

Emails sent to the Trump Organization and Cohen seeking comment received no response by press time.

McDougal signed a $150,000 deal with AMI for the story before the 2016 election. Cohen told The Times last month that he did not recall the communications. She later figured out why.

She seeks a declaration voiding her agreement with American Media. It was not an obligation. McDougal's attorney asserts in the lawsuit that his client was "tricked" into signing the agreement with A.M.I. and "misled" about its contents. So far, American Media has run one cover and roughly two dozen columns or posts featuring her.

"Thus, the suggestion that AMI "silenced" her is completely without merit".
