A tie vote would likely mean the deciding vote would be cast by VP Mike Pence, dooming the resolution.

Schumer and other Democrats think net neutrality will be a big issue in the 2018 midterm elections.




"If lawmakers care at all about the open internet, they should support this resolution to restore the Net Neutrality rules and Title II". "The Congressional Review Act gives Congress the power to reverse that corrupt and illegitimate decision and restore the basic protections that enable free expression, creativity, and innovation online".

This specific resolution, which would overturn the Federal Communications Commission's unpopular December 14 decision to destroy Net Neutrality, will be introduced after the agency delivers the final rules to Congress in the coming weeks.

Meanwhile, a separate effort to overturn the FCC's net-neutrality repeal has been gaining momentum.

According to Gizmodo, the IA would be a third party to the lawsuit and the court case wouldn't ensue for a couple of months but other companies have 50 days to join the suit. After the FCC repealed the 2015 rules, opponents have been gearing up legal arguments.
