Former Fox News producer claims O'Reilly broke agreement

A woman who entered a confidential settlement agreement with Bill O'Reilly in 2002 while at Fox News charged in a lawsuit Monday that the "serial abuser and coward" smeared her as a liar, breaking the terms of their deal.

Since Fox News cut ties with O'Reilly-just weeks after the Times published an April report detailing the numerous settlements O'Reilly and 21st Century Fox made regarding sexual harassment-he's taken numerous occasions to question the credibility of the anonymous women and reiterate his total innocence.

The lawsuit, which has been filed in the United States District Court for the Southern District of NY, states, "Mr. O'Reilly is the liar".

Arising out of the April 1, 2017 NY Times piece that revealed O'Reilly and FNC paid out around $13 million to blunt lawsuits over the now fired host's actions over the years, Bernstein's complaint in federal court in the Empire State calls BS on the immediate response and the one that followed this fall after more revelations of big O'Reilly payouts came out.

O'Reilly and spokesman Mark Fabiani did not immediately respond to a Law&Crime request for comment.

Bernstein alleges in her suit that she complained repeatedly about O'Reilly's mistreatment of her to the company's human resources department and top Fox News executives, but nothing was done. She did go to HR and other company executives to complain about him several times.




"Fox News has been aware of complaints about inappropriate behavior by Mr. O'Reilly since at least 2002, when Mr. O'Reilly stormed into the newsroom and screamed at a young producer, according to current and former employees, some of whom witnessed the incident".

O'Reilly allegedly made other, similar comments since then.

In a statement, Rachel Witlieb Bernstein's lawyer said since O'Reilly's history of alleged sexual harassment has become public, Bernstein has experienced "widespread distribution of disparaging, defamatory, and false claims against her".

Bernstein says the statement was false.

Bernstein argued that all this violates the non-disparagement and confidentiality clauses in her settlement.

Citing harm to Bernstein's reputation, "severe emotional distress, physical sickness, and loss of income", the complaint drills into the specific violations that it alleges both O'Reilly and FNC committed.
