DOJ Gives 5 Cities 'Last Chance' to Prove They Aren't Immigrant 'Sanctuaries'

  • A letter from the Justice Department released Thursday said officials believe New York is violating a law requiring cooperation on immigration enforcement

The cities of New York, Philadelphia and New Orleans are also out of compliance with federal law, according to the DOJ.

U.S. District Court Judge Harry Leinenweber ruled last month that the Justice Department couldn't withhold law-enforcement grant money from cities that refuse to follow tough new immigration requirements like giving the federal agents access to municipal jails. We will build relationships between the NOPD and all community members. The DOJ says this restricts the sharing of information regarding undocumented immigrants. "The NOPD will continue to focus on the arrest and conviction of violent criminals, regardless of their immigration status".

President Donald Trump's Justice Department this week sent letters contending Chicago and Cook County violated federal immigration laws a year ago when they were awarded public safety grants.

Several jurisdictions have filed suit against the federal government arguing such orders violate the 10th Amendment by compelling states to enforce federal immigration laws. "As such, we continue to state unambiguously that Chapter 41.6.1 does not restrict officers and employees from requesting information regarding immigration status from federal immigration officers".

"Instead of fear-mongering and false accusations, we urge you to work with mayors across the nation to tackle violent crime through smart, evidence-based policing", Landrieu said.

"While I firmly believe the city complies with federal laws, the city's position for some time has been that the Attorney General has overstepped his authority in even requiring us to comply with 8 U.S.C Section 1373 as a condition of a grant that has nothing to do with immigration enforcement", said Kenney during the press conference.

Since the inauguration and throughout the year, the City of Chicago has been at odds with the Trump Administration.

The Justice Department made the assertion in letters to Chicago police Superintendent Eddie Johnson and Cook County Board President Toni Preckwinkle.

In a October 11 letter to Landrieu, the Department of Justice threatened a grant award because of an NOPD practice that "appears to bar New Orleans officers from requesting information regarding immigration status from federal immigration officers".

"Unfortunately, the mayor has ignored my many warnings and continued to risk the safety, security and funding of our state's citizens", Landry said. Because Sessions is the best person to implement Trump's immigration policy, which was a lynchpin of his campaign. "Mitch Landrieu is playing politics at the expense of New Orleans". The pair have threatened to cut off federal funding to the cities - which include Hartford and New Haven - but so far that hasn't happened.

In August, the city of Chicago sued Sessions over its efforts to stop federal money from going to sanctuary cities through Byrne Justice Assistance Grants.

The Justice Department review brought better news for others.

Wednesday's letter demanded that the city certify that police officers aren't prohibited from contacting federal immigration authorities to ask about an individual's immigration status.
